Terms of Service
StorSmart
Last updated: July 24, 2026
1. Agreement and Eligibility
By downloading, installing, or using StorSmart ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf. By entering into these Terms, you represent that you have the legal capacity to form a binding contract.
StorSmart is operated by Data Stream Consulting ("we," "us," or "our"). Contact: support@datastreamconsulting.org
2. The Service
StorSmart is an inventory documentation app. It uses AI (SnapSense) to identify items from photos and generate estimated values. You can store, organize, and export your inventory for personal or business use.
3. AI Valuations — Important Disclaimer
Read this section carefully before using the SnapSense scanning feature.
The SnapSense feature uses artificial intelligence to generate item identifications and estimated values. These outputs are:
- Automatically generated by a machine learning model
- Estimates only — not professional appraisals, certified valuations, expert opinions, or fair market value determinations
- Not verified by a licensed appraiser, adjuster, accountant, attorney, or any other professional
Do not rely on SnapSense estimates for:
- Insurance claims or claim settlements
- Tax filings, deductions, or depreciation schedules
- Legal proceedings, estate settlements, or probate filings
- Financial reporting or business asset accounting
- Lending, financing, or collateral decisions
- Any decision where an accurate, professionally verified valuation is legally or financially material
For any of those purposes, you must obtain an independent professional appraisal from a qualified and licensed appraiser. AI-generated estimates may be significantly higher or lower than actual market value.
We make no warranty that SnapSense estimates are accurate, complete, or fit for any particular purpose. We expressly disclaim all liability for any loss, damage, denial of claim, tax penalty, or other consequence arising from reliance on AI-generated valuations.
4. Subscriptions and Billing
4.1 Plans
StorSmart offers subscription plans including a free trial period. Current pricing is displayed in the App at the time of purchase.
4.2 Free Trial
New subscribers receive a free trial period as stated in the App. Your payment method will be charged the applicable subscription fee at the end of the trial period unless you cancel before the trial ends. You will not receive a separate notice when the trial ends.
4.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel. Apple charges your payment method on file in your Apple ID account. You authorize this recurring charge by starting a subscription.
4.4 Cancellation
Cancel anytime through: iPhone Settings > [Your Name] > Subscriptions > StorSmart > Cancel Subscription. Cancellation takes effect at the end of the current billing period; you retain full access until then. We do not offer refunds for partial billing periods except where required by applicable law.
4.5 Price Changes
We may change subscription prices. We will provide at least 30 days' notice of price increases. Continued use after the new price takes effect constitutes acceptance.
4.6 Apple as Merchant of Record
All payments are processed by Apple Inc. We do not receive, see, or store your payment card information. Apple's media services terms and refund policies govern all transactions. For refund requests, visit reportaproblem.apple.com. Apple has no obligation to provide support for the App — that is our responsibility.
4.7 When Your Subscription Ends
Billing retry period. If a renewal payment fails, Apple may retry for up to 16 days. During that period your subscription remains active and your access is unchanged.
After your paid period ends (lapse). When a paid subscription ends and you are not in Apple's billing-retry grace window, your account is locked: you cannot browse your inventory, add items, or use paid features until you subscribe again. Your item records are kept, not deleted.
Data export on lapse. If you are the billing owner of the account (solo subscriber, household owner, or business organization owner), you can export your item records as CSV from the lock screen so you are never trapped. While your subscription is active, you may also export in JSON and other formats the App offers. Formatted deliverables (PDF summaries, insurance claim packets, business reports) require an active paid subscription — they are not part of the lapse export.
Seats and shared workspaces. If you are a household member or business staff seat (not the billing owner), you cannot renew or export the owner's workspace from the lock screen. When the owner's subscription ends, your access ends until the owner renews. Contact the account owner to restore access.
Photos and documents after lapse. Full-resolution photos and uploaded documents may be removed 12 months after lapse. We email you before removal. Your item records (names, values, categories, and history) remain.
Resuming. Subscribing again restores full access to your existing records. Nothing needs to be re-imported or re-created.
Cancellation and refunds. Subscriptions are managed through your Apple ID (Settings → Apple ID → Subscriptions). Cancellation takes effect at the end of the current billing period; you retain full access until then. Refunds are handled by Apple under the App Store terms; we cannot issue refunds directly.
5. Your Data
You own your inventory data. You can export it at any time in CSV or JSON format from within the App.
By using the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, and transmit your data solely as necessary to provide the service to you. We do not claim ownership of your photos or inventory records, and we will not use them for any purpose other than providing the service.
5.1 Household Sharing
If you create or join a household, items in shared spaces become visible to and editable by other household members — this includes photos, videos, descriptions, values, notes, locations, and sensitive item metadata. You are responsible for what you place in shared spaces and who you invite to your household. Removing a member or leaving a household stops their future access but does not retroactively undo edits, exports, or copies they already made while a member.
If you submit feedback, suggestions, or ideas about the App ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use that Feedback for any purpose without compensation or attribution to you.
See our Privacy Policy for full details on data handling.
6. Documents & Records Feature
StorSmart includes a Documents & Records feature that allows you to store scans or photos of physical documents. This feature has two modes:
SnapSense scanning (non-sensitive documents): Receipts, warranties, instruction manuals, and similar documents may be photographed and processed by SnapSense AI. The photo is transmitted to Anthropic's API for identification.
Manual entry (sensitive documents): The App will automatically reject SnapSense scanning of government-issued IDs, passports, Social Security cards, financial account documents, medical records, home titles, wills, and similar sensitive materials. For these, use the manual "Add Document" flow, which stores the document without AI processing.
Sensitive item protection: Items marked as sensitive are stored in your private vault and are visible when you are signed in to your account. Your inventory exports include all items you choose to export, including sensitive metadata. You are responsible for where you share export files.
Your responsibility: You are solely responsible for deciding what documents to store in StorSmart. Data Stream Consulting is not liable for any consequences arising from your decision to store sensitive personal, financial, legal, or medical documents in the App.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Submit photos of other people's property without their authorization
- Attempt to reverse engineer, decompile, disassemble, hack, or interfere with the App or its servers
- Use the App to generate false or inflated valuations for fraudulent insurance claims, tax evasion, or any other fraudulent purpose
- Attempt to circumvent content moderation by embedding instructions or malicious text in scanned images (prompt injection)
- Attempt to access another user's sensitive documents or bypass vault protections
- Resell, sublicense, or commercialize access to the App without our written permission
- Introduce malware, viruses, or malicious code into the App or its infrastructure
- Violate any applicable local, state, national, or international law or regulation
We reserve the right to suspend or terminate accounts that violate these terms without refund.
8. Intellectual Property
The App, its design, code, and branding (including the StorSmart and SnapSense names and logos) are owned by Data Stream Consulting and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the App for its intended personal or business inventory documentation purpose. No other rights are granted.
9. Third-Party Services and Apple
The App operates on Apple's iOS platform and is distributed through the Apple App Store. Apple is not a party to these Terms and has no obligation or liability to you regarding the App. In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, Apple's terms shall govern solely with respect to Apple's services.
10. Export Controls
The App is subject to United States export control laws. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government prohibited parties list.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We do not warrant that data will never be lost. Maintain your own backups for critical inventory records.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATASTREAM CONSULTING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF DATA, LOSS OF PROFITS, DENIAL OF INSURANCE CLAIMS, TAX PENALTIES, LEGAL COSTS, OR ANY DAMAGES ARISING FROM RELIANCE ON AI-GENERATED VALUATIONS.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) US $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Data Stream Consulting and its officers, directors, employees, and agents from any third-party claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) your violation of any third party's rights.
14. Dispute Resolution
14.1 Informal resolution first
Before initiating any formal dispute, you agree to contact us at support@datastreamconsulting.org and provide a written description of the dispute. We will attempt to resolve it informally within 30 days. This step is a condition precedent to any formal proceeding.
14.2 Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
14.3 Jurisdiction
Any dispute not resolved informally under Section 14.1 shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida. You consent to personal jurisdiction in those courts.
15. General Provisions
Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Data Stream Consulting regarding the App, and supersede all prior agreements or understandings.
No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
Force majeure: We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, power failures, internet outages, or government actions.
Service discontinuation. If we discontinue StorSmart, we will provide reasonable advance notice and an opportunity for billing owners to export their data before deletion.
Assignment: We may assign our rights and obligations under these Terms without notice. You may not assign your rights without our written consent.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the App or by email at least 14 days before taking effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
